Terms of Service
Moon Store Technology Inc. ("moonstore", "we", "our") provides its marketplace and services (described below) to you ("you" or the "User") through its website, platform and marketplace located at Cashbox.info (the "Platform") subject to the following Terms of Service (as amended from time to time, the "Terms"). By registering for an account on the Platform or otherwise using or accessing the Platform, you acknowledge that you have read and agree to these Terms.privacy policy and all such additional terms, guidelines and rules set forth on the Platform are hereby incorporated by reference into these Terms and are expressly agreed to and acknowledged by the User.
Please read these Platform Terms carefully because they contain an arbitration agreement and other important information about your legal rights, remedies, and obligations. The Arbitration Agreement requires (with limited exceptions) binding and final arbitration of claims you assert against us, and further (1) you will only be permitted to assert claims against Cashbox.info as a member in any class or representative action or proceeding, (2) you will be permitted only to seek relief (including monetary, injunctive, and declaratory relief) on an individual basis。
We reserve the right, at our sole discretion, to change or modify portions of these Terms of Service at any time. If we do this, we will post the changes on this page and indicate at the top of this page the date these Terms were last revised. We will also notify you through the platform user interface, email notification or other reasonable means. Any such changes will be effective fourteen (14) days after being posted, except that changes to new features of the Platform will be effective immediately. Your continued use of the Platform and beyond the effective date of any such changes constitutes your acceptance of the new Terms of Service.
What is Cashbox.info?
Cashbox.info is a platform for artists ("Creators") and collectors ("Collectors") to sell, buy, list for auction, make offers and bid (each, a "Transaction") on digital art on the non-fungible TON. Token-based ("digital artwork").
Enable smart contracts.Digital artwork on Cashbox.info is represented on a smart contract on the TON blockchain, which provides an immutable ledger of all transactions that occur on Cashbox.info (the "Smart Contract"). This means that all digital artwork is outside the control of any party, including Cashbox.info, and is subject to many risks and uncertainties. We neither own nor control MetaMask, Coinbase, the TON network, your browser, or the various features you use to enable you to use the Platform.ableaccessor the use of any other third party sites, products or services. We are not responsible for the acts or omissions of any such third parties or for any damages you may suffer as a result of your transactions or any other interactions with any such third parties.
non-custodial.Although Cashbox.info provides a marketplace for digital artwork, it does not purchase, sell or custody or own any digital artwork. The Platform facilitates users' collection of digital artwork, but neither Cashbox.info nor the Platform is the custodian of any digital artwork. Users understand and acknowledge that smart contracts do not at any time grant Cashbox.info the right to custody, possess or control any digital artwork or cryptocurrency for the purpose of facilitating transactions on the platform. You confirm that you are aware and acknowledge that Cashbox.info is a non-hosted service provider and has designed the Platform to be accessible directly to users without the involvement or action of Cashbox.info or any third party.
How do I use Cashbox.info?
Your registration obligations: Anyone can browse Cashbox.info without registering an account. You may be required to register with Cashbox.info to access and use certain features on the Platform, such as participating as a creator or collector. If you choose to register for the Platform, you agree to provide and maintain true, accurate, current and complete information about yourself as prompted by our registration form. Registration data and certain other information about you are governed by our Privacy Policybundle.You mustMust18 years or olderTo register for a creator account and bid on any digital artwork.
Member Accounts, Passwords and Security:You are responsible for maintaining the confidentiality of your account and password (if any) and are fully responsible for any and all activities that occur under your password or account. You agree to (a) immediately notify Cashbox.info of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account each time you visit Cashbox.info. Cashbox.info will not be liable for any loss or damage arising from your failure to comply with this section.
Connect your wallet: In order to participate in the marketplace as a creator or collector, you must be connected to the TON Wallet (or other permitted e-wallet). TON Wallet (or other permitted e-wallets) is an e-wallet that allows you to purchase, store, and participate in transactions using the native TON blockchain cryptocurrency, $TON, or supported tokens such as $USDT. All transactions on Cashbox.info are conducted in $TON, the native token of the TON blockchain, or in supported tokens such as $USDT.
Modifications to the platform:Cashbox.info reserves the right to modify or discontinue, temporarily or permanently, the Platform (or any part thereof) with or without notice. You agree that Cashbox.info will not be liable to you or any third party for any modification, suspension or discontinuance of the Platform.
What are the rules for using Cashbox.info?
When using Cashbox.info no user is allowed to:
Manipulate the price of digital art in any way, including bidding on your own items, blocking bids, or using Cashbox.info to conceal financial activity.
Email or otherwise upload any content that (i) infringes any intellectual property or other proprietary right of any party; (ii) that you do not have a right to upload under any law or under contractual or fiduciary relationships; (iii) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; (iv) poses or creates a privacy or security risk to any person; (v) constitutes unsolicited or unauthorized advertising, promotional materials, commercial activities and/or sales, "junk mail," "spam," "chain letters," "pyramid schemes," "contests," "sweepstakes," or any other form of solicitation; (vi) is unlawful, harmful, threatening, abusive, harassing, infringing, excessively violent, defamatory, vulgar, obscene, pornographic, defamatory, invasive of another's privacy, racially hateful, or otherwise objectionable; (vii) is, in the sole judgment of Cashbox.info, objectionable or restricts or inhibits any other person from using or enjoying the Platform, or may expose Cashbox.info or its users to any harm or liability of any kind;
Interfere with or disrupt the Platform or servers or networks connected to the Platform, or disobey any requirements, procedures, policies or regulations of networks connected to the Platform; or
Violate any applicable local, state, national or international law, or any regulation having the force of law, including but not limited towith the U.S. Department of the Treasury’s Office of Foreign Assets Control (“OFAC”) (in the case of the U.S. government, but may be replaced by any other country if necessary), or with anyIllegal profit-making activities;
Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
solicit personal information from anyone under the age of 18;
Collect or collect email addresses or other contact information of other users from the Platform by electronic or other means for the purpose of sending unsolicited emails or other unsolicited communications;
Advertise or offer to sell or buy any goods or services for any commercial purpose not specifically authorized;
Further or promote any criminal activity or enterprise, or provide instructional information regarding illegal activities, including for the purpose of concealing economic activity, money laundering or financing of terrorism;
Obtain or attempt to access or otherwise obtain any materials or information through any means not intended or provided for by the Platform;
Use any robot, spider, site search/retrieval application or other device to retrieve or index any portion of the Platform or content posted on the Platform, or collect information about its users for any unauthorized purpose;
Create user accounts by automated means or under false or fraudulent pretenses;
Access or use the Platform to create products or services that compete with any of our products or services.
How do I become a creator?
Artists need to be invited or become a creator on Cashbox.info. Selling invitations in exchange for $TON, $USDT or any other benefit is strictly prohibited. If Cashbox.info becomes aware that any invitations have been sold to third parties, Cashbox.info may suspend or otherwise terminate your access to Cashbox.info.
Cashbox.info has complete discretion in selecting artists for its marketplace and does not guarantee or commit that any artist will be approved as a creator, even if requested by Cashbox.info.
What intellectual property rights does the platform have?
Creator rights
The Creator owns all legal right, title and interest in and to all intellectual property rights in the digital artwork minted by the Creator on the Platform, including but not limited to copyrights and trademarks. As the copyright holder, the creator has the right to reproduce, prepare derivative works of digital art, distribute, display, or perform the digital art.
Creator hereby acknowledges, understands and agrees that the sale of a digital artwork on Cashbox.info constitutes an express representation, warranty and undertaking that Creator has not, will not and will not cause others to sell, mark or create another digital collection representing the same digital artwork, except for the Creator's ability to sell, tokenize or create cryptographic tokens or other digital assets that represent legal, financial or other interests associated with any proprietary rights belonging to Creator, without limitation under copyright law.
(ii) create and distribute digital or physically derived digital artworks based on the digital artwork; (iii) index digital artworks in electronic databases, indexes, catalogs; (iv) host, store, distribute and reproduce one or more copies of digital artworks in a distributed file preservation system, node cluster or other database (such as IPFS), or cause, direct or request others to do so.
The Creator expressly represents and warrants that the digital artwork they list on Cashbox.info contains only original content authorized for use by the Creator and does not contain unlicensed or unauthorized copyrighted content, including any images, designs, audio, video, portraits or other non-original content. There is a valid statement that the content was not created by the Creator, used without the Creator's authorization, is not in the public domain, or otherwise does not have fair use, and the Creator further represents and warrants that it has the right to incorporate the non-original content.
Collector's Rights
Collectors receive cryptographic tokens representing the creator’s digital artwork as property, but do not own the creation itself. The Collector may display and share the Digital Artwork, but the Collector does not have any legal title, title, or title to any copyright, trademark, or other intellectual property rights in the Digital Artwork, except for the limited license to the Digital Artwork granted in these Terms. By collecting a Digital Artwork, the Collector is granted a limited, worldwide, non-transferable, non-sublicensable, royalty-free license to display the Digital Artwork that is lawfully owned and properly acquired by the Collector.
The Collector's limited license to display the Digital Artwork, including, without limitation, the right to display the Digital Artwork privately or publicly: (i) to facilitate or share the Collector's purchase, ownership or interest, (ii) ) for sharing, promoting, discussing or commenting on the Digital Artwork; (iii) on third-party marketplaces, exchanges, platforms or applications in connection with offers to sell or trade Digital Artwork; (iv) in a decentralized virtual environment, virtual world, virtual gallery, virtual museum or other navigable and perceivable virtual environment.
Collectors have the right to sell, trade, transfer or use their digital art, but collectors are not allowed to use the digital art "for commercial purposes."
The Collector agrees that it shall not, and shall not permit any third party to do or attempt to do, any of the foregoing without the express prior written consent of the Creator in each case: (i) modify, distort, destroy or perform any other modification of the work that would be prejudicial to the honor or reputation of the Creator; (ii) use the Digital Artwork to promote, market or sell any third party product or service; (iii) Use the Digital Artwork in conjunction with images, videos, or other forms of media that depict hatred, intolerance, violence, cruelty, or any other form of media that could reasonably be considered to constitute hate speech or otherwise violate the rights of others; (iv) incorporate the Digital Artwork into a film, video, video game, or any other form of media for commercial purposes, unless such use is expressly permitted by these Terms or is solely for your collector's personal, non-commercial use; (v) Sell, distribute for commercial gain, or otherwise commercialize merchandise containing, containing, or consisting of a digital artwork; (vi) attempt to trademark, copyright, or otherwise obtain additional intellectual property rights for a digital artwork; (vii) attempt to mint, tokenize, or create additional cryptographic tokens representing the same digital artwork, whether on or off the Cashbox.info platform; (viii) counterfeit, misrepresent, or conceal the authorship of a digital artwork; or (ix) Otherwise exploit the digital artwork for the commercial benefit of the Collector or any third party. Distribute for commercial gain, or otherwise commercialize goods containing, containing or consisting of a digital artwork; (vi) attempt to trademark, copyright or otherwise obtain additional intellectual property rights for a digital artwork; (vii) attempt to mint, tokenize or create additional cryptographic tokens representing the same digital artwork, whether on or off the Cashbox.info platform; (viii) counterfeit, misrepresent or conceal the authorship of a digital artwork; or (ix) Otherwise exploit the digital artwork for the commercial benefit of the Collector or any third party. Distribute for commercial gain, or otherwise commercialize goods containing, containing or consisting of a digital artwork; (vi) attempt to trademark, copyright or otherwise obtain additional intellectual property rights for a digital artwork; (vii) attempt to mint, tokenize or create additional cryptographic tokens representing the same digital artwork, whether on or off the Cashbox.info platform; (viii) counterfeit, misrepresent or conceal the authorship of a digital artwork; or (ix) Otherwise exploit the digital artwork for the commercial benefit of the Collector or any third party. or otherwise acquire additional intellectual property rights in a digital artwork; (vii) attempt to mint, tokenize or create additional cryptographic tokens representing the same digital artwork, whether on or off the Cashbox.info platform; (viii) falsify, misrepresent or conceal the authorship of a digital artwork; or (ix) otherwise exploit a digital artwork for the commercial benefit of a collector or any third party. or otherwise acquire additional intellectual property rights in a digital artwork; (vii) attempt to mint, tokenize or create additional cryptographic tokens representing the same digital artwork, whether on or off the Cashbox.info platform; (viii) falsify, misrepresent or conceal the authorship of a digital artwork; or (ix) otherwise exploit a digital artwork for the commercial benefit of a collector or any third party.
The Collector irrevocably releases, releases and forever releases Cashbox.info and its subsidiaries, affiliates, officers and successors from any liability for any direct or indirect copyright or trademark infringement arising from Cashbox.info's use of Digital Artworks under these Terms.
Platform content, software and trademarks:You acknowledge and agree that the Platform may contain content or functionality that is protected by copyrights, patents, trademarks, trade secrets or other proprietary rights and laws ("Platform Content"). Except as expressly authorized by Cashbox.info, you agree not to modify, copy, frame, scrape, rent, lease, loan, sell, distribute or create derivative works based on the Platform or the Platform Content, in whole or in part. In connection with your use of the Platform, you will not engage in or use any data mining, robots, scraping or similar data gathering or extraction methods. If Cashbox.info blocks your access to the Platform (including by blocking your IP address), you agree not to take any steps to circumvent such blocking (for example, by blocking your IP address or using a proxy IP address). Any use of the Platform or Platform Content not specifically authorized herein is strictly prohibited. The technology and software underlying the Platform or distributed in connection therewith are the property of Cashbox.info, our affiliates and our partners (the “Software”)。You agree not to copy, modify, create derivative works of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense or otherwise transfer any rights in the Software. Cashbox.info reserves any rights not expressly granted herein.
The Cashbox.info name and logo are trademarks and service marks of moon store technology Inc. (collectively, the "Cashbox.info Trademarks"). Other company, product and service names and logos used and displayed through the Platform may be the trademarks or service marks of their respective owners, who may or may not endorse or be affiliated with or associated with Cashbox.info. In each case, nothing contained in these Terms of Service or the Platform shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Cashbox.info Trademark displayed on the Platform without our prior written permission. All goodwill generated from the use of the Cashbox.info trademarks will inure to our exclusive benefit.
Third Party Materials:Under no circumstances will Cashbox.info be liable in any way for any content or materials of any third party (including users), including without limitation for any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any such content. You acknowledge that Cashbox.info does not pre-screen Content, but that Cashbox.info and its designees will have the right (but not the obligation) in their sole discretion to refuse or remove any Content that is available through the Platform. Without limiting the foregoing, Cashbox.info and its designees will have the right to remove any content that violates these Terms of Service or is otherwise objectionable in the sole discretion of the Platform. You agree that you must evaluate and bear all risks associated with,
User Content transmitted via the Platform:You represent and warrant that you own all right, title and interest in and to content, digital artwork or other materials that you upload or share with other users or recipients through the Platform (collectively, "User Content"). User Content, including without limitation all copyright and publicity rights contained therein. By uploading any User Content, you hereby grant and will grant to Cashbox.info and its affiliates a non-exclusive, worldwide, royalty-free, fully paid, transferable, sublicensable, perpetual, irrevocable license to reproduce, display, upload, perform, distribute, store, modify and otherwise use your User Content in connection with the operation of the Platform or its promotion, advertising or marketing, in any form, media or technology now known or hereafter developed.
Any questions, comments, suggestions, ideas, feedback or other information regarding the Platform ("Submissions") provided by you to Cashbox.info are non-confidential and Cashbox.info shall be entitled to the unrestricted use and dissemination of these Submissions for any purpose, commercial or otherwise, without acknowledgment or compensation to you.
Cashbox.info may preserve Content and may disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: (a) comply with legal process, applicable law, or governmental request; (b) enforce these Terms of Service; (c) respond to claims that any Content violates the rights of a third party; (d) protect the rights, property, or personal safety of Cashbox.info, its users, and the public. You understand that the technical processing and transmission of the Platform, including your Content, may involve (a) transmissions over various networks and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
Copyright Complaint:Cashbox.info respects the intellectual property rights of others, and we ask our users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, you should notify Cashbox.info of your infringement claim by following the procedures set forth below.
Cashbox.info will process and investigate notices of alleged infringement and will take appropriate action under the Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws with respect to any alleged or actual infringement. Notifications of claimed copyright infringement should be sent via emailtoCashbox.info’s official email address: contact@cashbox.info
To be effective, the notice must be in writing and contain the following information:
An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
A description of the copyrighted work or other intellectual property that you claim has been infringed;
Describe where the material that you claim is infringing is located on the Platform, with sufficient detail so that we can find it on the Platform;
your address, phone number and email address;
A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright or intellectual property owner, its agent, or the law;
A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf.
Counter notification: If you believe that your User Content that was removed (or to which access was disabled) is not infringing, or that you have authorization from the copyright owner, the copyright owner's agent, or otherwise by law to upload and use the content in your User Content, you may send a written counter-notification containing the following information to the copyright agent:
Your physical or electronic signature;
Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled;
A statement that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification of the content; and
Your name, address, telephone number and email address, a statement that you consent to the jurisdiction of the federal court located in the Northern District of California, and a statement that you will accept service of process from the person who provided notification of the alleged infringement.
If the Copyright Agent receives a counter-notification, Cashbox.info will send a copy of the counter-notification to the original complaining party informing that person that they may replace the removed content or cease disabling the content within 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member or user, it may take 10 to 14 business days or more after receipt of the counter-notification to replace the removed content or restore access to it, at our sole discretion.
Repeat Infringer Policy: Pursuant to the DMCA and other applicable laws, Cashbox.info has adopted a policy to terminate, in appropriate circumstances and at Cashbox.info's sole discretion, users who are deemed to be repeat infringers. Cashbox.info may also, in its sole discretion, restrict access to the Platform and/or terminate the membership of any user who infringes the intellectual property rights of others, regardless of any repeat infringement.
User agrees to cooperate with Cashbox.info
The Creator expressly agrees to refund to the Collector and/or Cashbox.info all fees received from the sale of digital artwork that is subsequently removed from the Site pursuant to a valid DMCA request, but the Creator fails to timely submit a valid DMCA counter-notification. Cashbox.info will not be liable to any User for removing an allegedly infringing work from the Platform or otherwise complying with its legal obligations under the DMCA.
Creators, collectors and all users expressly agree to cooperate with and promptly respond to Cashbox.info's investigations, requests and inquiries related to DMCA disputes or allegations of infringement. User agrees to initiate a "destroy" transaction upon request by Cashbox.info to permanently remove or otherwise allegedly infringing digital artwork from the Cashbox.info Marketplace pursuant to a valid DMCA takedown notice.
What fees does Cashbox.info charge?
auction. The terms and mechanics of the auction are set out in myourHelp Centerincorporateenter these terms.
cost. The fees for your first sale of digital art on Cashbox.info are as follows:
You agree and understand that all fees, commissions and royalties are transferred, processed or initiated directly through one or more smart contracts on the TON blockchain network.
Cashbox.info generally does not charge any fees, commissions or royalties for transactions that occur outside Cashbox.info. User irrevocably releases, releases and forever discharges Cashbox.info and its subsidiaries, affiliates, officers and successors from any liability for royalties, fines or fees not received from any OTC transaction.
All transactions on Cashbox.info, including but not limited to minting, tokenization, bidding, listing, issuance, purchase or confirmation, are facilitated by existing smart contracts on the TON network。The TON network requires EthersquareA transaction fee ("Gas Fee") is paid for each transaction that occurs on the network and therefore for each transaction that occurs on Cashbox.info.HereThe value of s Fees often changes unpredictably and is completely beyond the control of Cashbox.info. User acknowledges that under no circumstances will a contract, agreement, offer, sale, tender or other transaction on Cashbox.info be invalid, voidable, recoverable or otherwise unenforceable or otherwise inadmissible due to unknown or excessive gas fees for a given transaction.
tax. Users are responsible for paying any and all sales, use, VAT and other taxes, duties and assessments now or hereafter claimed or imposed by any governmental authority "in connection with your use of Cashbox.info (including without limitation any taxes that may become payable by reason of your possession, transfer, purchase, sale or creation of any Artwork).
test platform. Certain features on Cashbox.info may be available while still in "beta" form (the "Beta Platform"). Cashbox.info will do its best to identify "Beta" platforms by marking them on their platform. By accepting these Terms or using the Beta Platform, you understand and acknowledge that the Beta Platform is provided as a "Beta" version and is provided on an "as is" or "as available" basis. "Beta" Platforms may contain bugs, bugs and other issues. You assume all risks and all costs associated with using the "Beta" version of the Platform, including, without limitation, any Internet access charges, backup charges, charges incurred for the use of your equipment and peripherals, and any damage to software, information or data. In addition, we have no obligation to provide any maintenance, technical or other support for the Beta Platform.
Where is my privacy?
Our Privacy Policy is part of these Terms. Please review the Cashbox.info Privacy Policy, which also governs the Platform and informs users of our data collection practices.
Other legal terms
compensation and release: You agree to release, indemnify and hold harmless Cashbox.info and its affiliates, and their officers, employees, directors and agents (collectively, the "Indemnitees") from and against any and all losses, damages, expenses, including reasonable attorneys' fees, rights, claims, actions and injuries of any kind (including death) arising out of or relating to your use of the Platform, any User Content, your connection to the Platform, your violation of these Terms of Service, or your violation of any rights of another. Notwithstanding the foregoing, you will have no obligation to indemnify or hold harmless any Indemnified Person for any liability, loss, damage or expense arising from any act or omission of such Indemnified Person.Harmful.If you are a California resident, you waive California Civil Code Section 1542, which states: "A general release does not extend to claims which the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and which, if known by him or her, would materially affect his or her settlement with the debtor or releasing party." If you are a resident of another jurisdiction, you waive any similar statute or principle. (U.S. government is used as an example, but can be replaced with any other country if necessary)
Disclaimer: Platform transactions, including but not limited to primary sales, secondary market sales, listings, offers, bids, acceptances and other operations, utilizing experimental smart contracts and blockchain technology, including non-fungible tokens, cryptocurrencies, consensus algorithms and decentralized or peer-to-peer networks and systems. User acknowledges and agrees that such technology is experimental, speculative and inherently risky and may be subject to errors, glitches, timing errors, hacking and theft, or changes to the rules of the TON blockchain protocol (i.e., "forks"), which may adversely affect smart contracts and may expose you to the risk of total loss, forfeiture of digital currency or digital art, or loss of the opportunity to buy or sell digital art. Your use of the Platform is at your own risk. THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. Cashbox.info expressly disclaims all warranties of any kind, whether express, implied, or statutory, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and title.
Cashbox.info does not guarantee that (I) the Platform will meet your requirements, (II) the Platform will be uninterrupted, timely, secure or error-free, (III) the results that may be obtained from the use of the Platform will be accurate or reliable, or (IV) the quality of any products, Platforms, information or other materials purchased or obtained by you through the Platform will meet your expectations.
